Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your use of the pike; application and website (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and pike;, operated from the Kingdom of Bahrain.

2. Eligibility

You must be at least 13 years old to use pike;. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts that we reasonably believe belong to users under 13.

3. Your Account

You are responsible for maintaining the security of your account. You agree to provide accurate information during registration, keep your login credentials secure, notify us immediately of any unauthorised access, and not share your account with others. Your user code (@handle) is permanent and cannot be changed after creation. One account per person — creating multiple accounts is not permitted.

4. Acceptable Use

You agree not to use pike; to send spam, bulk messages, or unsolicited promotions; harass, threaten, or abuse other users; share illegal content, including but not limited to child exploitation material; impersonate another person or entity; attempt to gain unauthorised access to other users' accounts; distribute malware, viruses, or harmful code; violate any applicable law of the Kingdom of Bahrain or any other jurisdiction; or use the Service for any commercial purpose without our written consent.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

5. Content

You retain ownership of the content you send through pike;. By using the Service, you grant us a limited licence to store and transmit your content solely for the purpose of delivering it to your intended recipients. We do not claim ownership of your messages, photos, or media. We do not access, review, or use your content for any purpose other than delivering the Service.

6. pike; Pro

pike; Pro is a one-time, non-recurring in-app purchase that unlocks additional features including Ghost Mode, Hide Last Seen, Hide Read Receipts, and Gaming Presence. Purchases are processed by Apple (App Store) or Google (Play Store) and are subject to their respective terms and refund policies. We do not handle payment information directly. Pro features may be expanded over time. Existing Pro users receive all new Pro features at no additional cost. Refund requests should be directed to Apple or Google through their standard refund processes.

7. Disappearing Messages and View-Once Media

When you enable disappearing messages, content is automatically deleted after the specified timeframe. View-once media is permanently deleted after the recipient opens it. We cannot recover deleted content. You acknowledge that recipients may take screenshots or photographs of their screen before content disappears, and we cannot prevent all methods of content capture.

8. Privacy and Data Protection

Your privacy is fundamental to our Service. Our handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the Kingdom of Bahrain's Personal Data Protection Law (Law No. 30 of 2018) and its implementing resolutions.

9. Intellectual Property

The pike; name, logo (the semicolon mark), design, and application code are the intellectual property of pike; and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written consent.

10. Third-Party Services

pike; may integrate with third-party services including Steam and Riot Games (for gaming presence), Spotify and Apple Music (for music status), and Apple/Google payment systems (for Pro purchases). Your use of these integrations is subject to those services' respective terms and privacy policies. We are not responsible for the practices of third-party services.

11. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

12. Limitation of Liability

To the maximum extent permitted by the laws of the Kingdom of Bahrain, pike; shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or business interruption. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid for pike; Pro, or BD 10 (approximately $26.50), whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless pike; and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the app or by email at least 14 days before they take effect. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you may delete your account.

15. Termination

You may stop using pike; and delete your account at any time through Settings. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Kingdom of Bahrain. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain. Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
